The information we collect depends on how you interact with Beam, the features you use, your subscription plan, and the device or platform through which you access the Service.

When you create or use a Beam account, we may collect information you provide directly to us, such as your name, email address, login and authentication details, profile information, Studio or business information where applicable, subscription details, account settings, communication preferences, and any other information you choose to provide.

We also process the content you create, upload, or store through Beam. This may include class plans, custom exercises, notes, photographs, videos, links, calendar information, exercise submissions, community posts, comments, and other User Content.

Some Beam features allow you to enter your own notes or free text. Because you control what you add to these fields, you may choose to enter information that Beam did not request. The availability of a free-text field does not mean that Beam asks for or encourages the submission of medical, health, or other sensitive information. Beam does not provide dedicated client medical profiles and does not intentionally request diagnoses, medical reports, treatment records, clinical documentation, or confidential patient files.

When you access or interact with Beam, we may automatically collect certain technical and usage information. This may include your IP address, device type, browser type, operating system, application version, login and session information, approximate location derived from your IP address, feature interactions, device or application identifiers where applicable, diagnostic and performance information, and security-related events.

If you use Beam’s community features, we may process the posts, comments, images, links, and other content you choose to publish. Content you intentionally post in community areas may be visible to other Beam users. We may also process support requests or reports relating to community activity.

When you contact the Beam team for support or assistance, we may collect your name, email address, the details of your request, correspondence, attachments you choose to provide, and any other information reasonably necessary to respond to you.

We use personal information primarily to provide, maintain, secure, and improve Beam.

This includes creating and authenticating accounts, storing classes and exercises, providing class-planning and calendar functionality, operating BeamFit, supporting community and Studio features, processing subscriptions, responding to support requests, maintaining the technical Service, detecting fraud or abuse, protecting account security, enforcing our Terms, investigating technical or security incidents, communicating important account or subscription information, developing or improving features, complying with applicable legal obligations, and protecting Beam’s legal rights.

Where permitted by law, we may also use contact information to communicate with you about Beam features, educational content, subscriptions, updates, or promotions.

You can opt out of marketing communications without disabling important operational communications relating to your account, billing, security, support, legal notices, or subscriptions.

We may use aggregated or de-identified information for analytics, business planning, product improvement, and similar purposes where that information no longer reasonably identifies you.

Beam is not designed as a medical-record or clinical-information system and does not intentionally request detailed medical information about instructors, students, or clients.

You should not enter diagnoses, treatment records, medical reports, healthcare documentation, confidential patient files, or unnecessary personally identifiable health information through Beam.

If you voluntarily enter sensitive information into a free-text field despite these instructions, Beam may technically process that information as part of providing the relevant feature. That does not mean Beam requested the information or intended the feature to serve as a medical record.

You are responsible for making sure that you have an appropriate legal basis, authorization, or permission before providing personal information relating to another person.

When you use BeamFit, we may process the prompt you enter, the response generated for you, relevant application context, usage information, and technical information necessary to provide, secure, troubleshoot, and maintain BeamFit.

BeamFit relies on external artificial intelligence technology. Information submitted through BeamFit may therefore be transmitted to an external AI service provider as necessary to process your request and generate a response.

Please do not enter personally identifiable client medical information, medical records, diagnoses, confidential health documentation, passwords, financial credentials, or other unnecessary sensitive information into BeamFit.

Beam does not use BeamFit prompts or responses to train its own artificial intelligence models unless we clearly disclose a material change to that practice and obtain any consent required by applicable law.

The external technologies used to provide BeamFit may change as the Service develops. Where disclosure of a particular provider is legally required or materially relevant to your privacy rights, we will make the appropriate disclosure.

When you purchase a subscription, we may process information relating to your subscription plan, transaction amount, payment status, renewal status, billing history, transaction identifiers, and limited payment-related information.

Payments may be processed through third-party payment providers. Complete payment-card details are generally submitted directly to the relevant payment provider rather than stored directly by Beam.

A payment provider may process information according to its own applicable terms and privacy practices.

The payment options available to you may vary depending on your country, platform, device, or applicable marketplace requirements.

Beam may use cookies, software development kits, local storage, pixels, and similar technologies where appropriate to operate, protect, measure, and improve the Service.

These technologies may support functions such as authentication, account sessions, security, user preferences, checkout, essential application functionality, analytics, performance measurement, and, where implemented, advertising attribution.

Some technologies are necessary for Beam to operate correctly and cannot reasonably be disabled without affecting important functionality.

Where applicable law requires consent before non-essential analytics, advertising, or similar tracking technologies are activated, Beam will provide an appropriate consent or choice mechanism.

As Beam’s marketing and analytics systems develop, we may introduce additional measurement or advertising technologies. We will update our disclosures and user controls where those changes materially affect how personal information is processed.

We do not describe future or planned tracking technologies as though they are already collecting information.

Beam does not sell customer email lists or rent customer databases to data brokers.

We may share personal information with trusted service providers that help us operate Beam. These providers may support activities such as hosting, data storage, authentication, payment processing, artificial intelligence, communications, analytics, security, customer support, and other technical or operational functions.

We do not publicly list every infrastructure or technology provider because our technical architecture may evolve over time. Where identifying a particular provider is required by law, required by a major platform, or materially relevant to your privacy rights, we will provide the appropriate disclosure.

We may retain and internally process limited information after account deletion where reasonably necessary for security, fraud prevention, technical recovery, dispute resolution, legal compliance, transaction documentation, accounting, enforcement of our agreements, or other legitimate operational requirements. Removal of an account from user-facing areas of Beam does not necessarily mean that every related internal record is immediately erased.

We may also disclose information where reasonably necessary to comply with law, respond to lawful legal process, investigate fraud or security threats, protect Beam or our users, enforce our agreements, or protect the rights, safety, or property of another person.

If Beam becomes involved in a merger, acquisition, financing, restructuring, asset transaction, or sale of all or part of the business, relevant personal information may be transferred as part of that transaction, subject to applicable privacy obligations.

If you participate in a Studio workspace, information associated with that workspace may be visible to authorized Studio administrators according to the permissions and functionality available through Beam.

Where permitted by law, Beam may use your contact information to communicate with you about new functionality, educational content, subscriptions, promotions, offers, or other Beam-related updates.

You can unsubscribe from promotional email using the unsubscribe option included in the communication, through available account settings, or by contacting support@beamclasscreator.com.

Opting out of marketing does not stop Beam from sending communications reasonably necessary for account operation, password recovery, security, billing, subscription management, support, legal notices, or similar transactional purposes.

Beam does not currently sell personal information to third parties for their independent direct marketing.

Some privacy laws define terms such as “sale,” “sharing,” or targeted advertising more broadly than an ordinary sale of data for money. If Beam later uses advertising technologies that fall within one of those statutory definitions, we will provide any notices, consent mechanisms, or opt-out rights required by applicable law.

Beam is operated by a company based in the United States and may work with service providers that process information in the United States and other countries.

This means that personal information may be processed outside the country where you live.

The privacy and data-protection laws of those countries may differ from those in your home jurisdiction.

Where applicable law requires particular safeguards for international transfers, Beam will use legally recognized transfer mechanisms, contractual protections, adequacy arrangements, or other appropriate safeguards.

Beam keeps personal information for as long as reasonably necessary to provide the Service, fulfill the purposes described in this Privacy Policy, maintain the security and integrity of Beam, protect legitimate business and legal interests, and comply with applicable legal requirements.

The appropriate retention period depends on the nature of the information, whether an account remains active, financial and tax obligations, contractual requirements, security and fraud-prevention needs, technical recovery requirements, disputes, potential legal claims, and applicable law.

When an account is deleted, the user’s account and associated content are immediately removed from user-facing areas of Beam. Certain identifiable information and User Content may continue to be retained within Beam’s internal systems through our soft-deletion process.

Information retained after account deletion may be used for legitimate purposes such as security, fraud prevention, Service integrity, dispute resolution, enforcement of agreements, technical recovery, legal compliance, accounting, tax obligations, and transaction documentation.

Transaction and accounting records may be retained for the period required or permitted by applicable law. Limited suppression information may also be retained to ensure that marketing opt-outs continue to be honored.

Information stored in backups may remain until it is removed or overwritten through Beam’s ordinary backup-retention and rotation processes.

Aggregated or genuinely de-identified information that no longer reasonably identifies an individual may be retained for longer periods for product improvement, analytics, security, and legitimate business purposes.

Beam allows users to initiate account deletion directly through the Service.

When you delete your Beam account, your account and associated content are immediately removed from user-facing areas of Beam. Your profile, private content, and other account-linked material will no longer be visible or available through the ordinary user experience.

Beam currently uses a soft-deletion process. This means that certain account information and User Content may remain in our internal systems after the account has been removed from the user-facing Service.

We may retain this information where reasonably necessary for Service security and integrity, fraud prevention, technical recovery, dispute resolution, enforcement of agreements, transaction documentation, accounting, tax or regulatory compliance, or other legitimate legal and operational requirements.

We do not retain soft-deleted account information merely to continue ordinary marketing. We may retain limited information necessary to record and honor an unsubscribe or marketing opt-out request.

Some information may also remain temporarily in backups until those backups are removed or overwritten through our ordinary backup-management process.

Depending on where you live and which privacy laws apply to Beam, you may have rights relating to your personal information.

These may include the right to request access to information Beam holds about you, correct inaccurate information, request deletion, obtain certain information in a portable format, restrict or object to certain processing, withdraw consent, opt out of certain targeted advertising or legally defined sharing, and submit a complaint to an appropriate privacy regulator.

Privacy rights vary by jurisdiction and may be subject to legal exceptions.

You may submit a privacy request to support@beamclasscreator.com or through Beam’s in-app support functionality.

Beam may take reasonable steps to verify your identity and authority before responding to a privacy request.

Where applicable law provides a right to appeal Beam’s response to a privacy request, you may submit your appeal through the same contact method and identify the request being appealed.

Beam will not unlawfully discriminate against you for exercising an applicable privacy right.

Residents of certain U.S. states may have additional privacy rights where the relevant state privacy law applies to Beam and the particular processing activity.

Depending on the applicable law, these rights may include access, correction, deletion, portability, opting out of certain targeted advertising, opting out of legally defined sales or sharing, limiting certain uses of sensitive information, or appealing certain decisions concerning privacy requests.

Beam does not sell customer email lists or personal information for monetary consideration.

Where future advertising or data practices trigger additional state-law requirements, Beam will implement the disclosures and controls required by applicable law.

Where the European Union General Data Protection Regulation, United Kingdom GDPR, or comparable data-protection laws apply, BEAM FITNESS CLASS CREATOR LLC generally acts as the controller of personal information Beam collects directly in connection with ordinary Service operations.

Depending on the circumstances, Beam may process personal information because doing so is necessary to perform our contract with you, because processing is required by law, because you have provided consent, or because Beam has a legitimate interest in operating, securing, improving, and protecting the Service that is not overridden by your applicable privacy rights.

Depending on applicable law, your rights may include access, rectification, erasure, restriction, objection, portability, withdrawal of consent, and the ability to lodge a complaint with an appropriate supervisory authority.

Withdrawing consent does not affect processing that was lawfully performed before consent was withdrawn.

Beam is a general-audience platform designed primarily for Pilates instructors and is not directed to children under 13.

You must be at least 13 years old to use Beam. Users who are below the age of legal majority where they live must have permission from a parent or legal guardian.

Beam does not knowingly seek personal information from children under 13.

If Beam obtains actual knowledge that personal information has been collected from a child under 13 in circumstances where parental consent is legally required, we may take appropriate steps to remove the information and associated account.

Parents or guardians who believe that a child under 13 has provided personal information to Beam may contact support@beamclasscreator.com.

Under the current U.S. COPPA framework, online services directed to children under 13, as well as general-audience services with actual knowledge that they are collecting personal information from a child under 13, are subject to specific parental notice and consent requirements. Beam uses reasonable administrative, organizational, and technical measures designed to protect personal information against unauthorized access, misuse, loss, alteration, destruction, or disclosure.

These measures may include safeguards relating to authentication, access management, secure transmission, account security, infrastructure security, backups, monitoring, and restricted administrative access.

Our team will continue to review and maintain appropriate security practices as Beam develops.

However, no internet-connected service, database, transmission method, or security system can guarantee absolute security.

You are responsible for keeping your own login credentials secure and should contact Beam promptly if you believe your account has been accessed without authorization.

Beam may contain links to, integrate with, or rely on websites, services, technologies, or tools operated by third parties.

Where a third party operates independently from Beam, that third party may maintain its own terms and privacy practices.

Beam is not responsible for the privacy or security practices of independent third-party services that Beam does not control.

You should review the relevant privacy information before independently providing personal information to an external service.

Beam may update this Privacy Policy as our Service, technology, data practices, business operations, or applicable legal requirements change.

The “Last Updated” date at the beginning of this Privacy Policy identifies the current version.
